Please read these Terms of Service (“Terms”, “Terms of Service”) carefully before using our website tanglewood.co.za (the “Site”) and purchasing our products (the “Service”) operated by The Plant Owl (“we”, “us”, or “our”).
By accessing or using our Site and purchasing our products, you agree to be bound by these Terms. If you disagree with any part of these Terms, please do not use our Service.
1. Eligibility
You must be at least 18 years old or have the permission of a parent or legal guardian to use our Service.
2. Products
We sell living plants and related products. Due to the nature of living plants, please note that slight variations in colour, size, and shape are natural and to be expected. As fuchsias are summer flowering plants, they may not be in bloom when purchased outside of the summer months (approximately mid-October to March, depending on the variety). All images shown on the website were taken during the flowering period.
3. Orders
By placing an order through our Site, you warrant that you are legally capable of entering into binding contracts. We reserve the right to refuse or cancel orders at our sole discretion, including if products are listed incorrectly or become unavailable.
4. Pricing & Payment
All prices are listed in ZAR (South African Rand) and are subject to change without notice. We accept payment via PayFast (options listed at checkout). By providing payment information, you represent and warrant that you are authorised to use the payment method provided.
5. Shipping & Delivery
We ship living plants with care to ensure they arrive in good condition. Shipping times and fees are provided at checkout and may vary based on location, weather conditions or the courier company. We are not responsible for delays outside our control.
6. Live Arrival Guarantee & Returns
Please inspect your order upon arrival and contact us within 24 hours if there are any issues. Due to the perishable nature of living plants, returns are not accepted, but we may offer replacements or store credit at our discretion. Photos will be required to process claims.
7. Account
If you create an account with us, you are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account.
8. Prohibited Uses
You agree not to use the Site or our products for any unlawful purpose or to violate any laws in your jurisdiction.
9. Intellectual Property
All content on this Site, including images, text, graphics, logos, and trademarks, is the property of The Plant Owl and is protected by applicable intellectual property laws.
10. Limitation of Liability
To the maximum extent permitted by law, ThePlant Owl shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Site or our products.
11. Indemnification
You agree to indemnify and hold harmless The Plant Owl and its affiliates, employees, and agents from any claim or demand, including reasonable attorney’s fees, arising out of your violation of these Terms or your violation of any law or the rights of a third party.

These Terms shall be governed and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions.

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated “Effective Date”. Continued use of the Site after changes constitutes acceptance of the new Terms.
